Position on the EC legislative proposals of Public Procurement Directives and a Directive on Service Concessions

Overall EUREAU has taken note of the legislative proposals of the European Commission on the Procurement directive¹and on the Procurement by entities operating in the water, energy, transport and postal services sectors² and is happy to give a first contribution to the ongoing discussion of this important issue.

Development of EUREAU Position on the Directive on alternative dispute resolution (ADR – directive) – COM 2011/793

As customers are the natural focus point for water and waste water suppliers EUREAU would like to give an assessment of the draft of the ADR directive, COM 2011/793 dated 29.11.2011.

The sector is already very intensively regulated with both EC rules and national rules.

EUREAU welcomes in principle an ADR directive with rules which give a flexible implementation. Any directive has to respect the principles of subsidiarity and proportionality and leave to the member states to decide if they introduce an ADR or not, i.e. when there is no or only minor competition.
